Most property owners learn about a building violation in one of two ways: a notice taped to the door, or a title search that surfaces it at the worst possible moment. By the time it shows up in a closing package, the easy window for resolving it cheaply has already closed.

What makes NYC building violations expensive isn't the initial fine — it's the compounding. ECB penalties accrue interest daily from the date of issuance and convert into property liens before most owners realize they're delinquent. A $1,500 fine ignored for eighteen months doesn't stay $1,500. It becomes a lien on your deed, a problem for your lender, and a negotiating chip for the buyer's attorney.

  • ECB fines become property liens. Once OATH enters a default judgment, that balance attaches to your property. It shows up in title searches and must be satisfied before any sale or refinance can close.
  • Open violations kill deals. Lenders and buyers' counsel run violation searches as standard practice. A single open Class 1 DOB violation — or a stack of HPD Class C items — can trigger a price renegotiation or blow up a closing entirely.
  • Documented violations establish liability. If a tenant is injured in a condition that was the subject of an open violation, that violation is evidence. It doesn't matter whether you knew about it — the city's records say you did.

An OATH/ECB fine requires payment at nyc.gov/oath — or a hearing request filed within 30 days of issuance — or it defaults to judgment and starts accruing interest.
